Ustica aircraft disaster: the Supreme Court of Cassation confirms the damages to Itavia
€ 265 million will have to be paid and also compensation to the heirs
The Third Civil Section of the Court of Cassation upheld the sentence of the Court of Appeal of Rome last Spring, condemning the Ministry of Infrastructure and Transport and that of the Defense to compensate the heirs of the Itavia airline not only for the 265 million Euro already established, but also for the damages suffered for the financial disruption following the Ustica aircraft disaster. Then rejected the appeals presented by the State, confirming the version that to tear down the Douglas DC-9 on June 27, 1980 killing the 81 people on board was the explosion generated by a missile launched from another plane.
Obviously the mystery about who fired actually remains, but according to the Supreme Court if the two ministries had adopted "the conduct imposed by the legal obligations, the event would not have occurred". If the skies had been properly guarded then it would have been possible to perceive the presence of other planes along the route followed by the DC-9.
